California Residents: Privacy Rights

The CCPA is not intended to apply to nonprofits, but there may be some application in some circumstances. USA Kid Net adapts its privacy policy to accommodate CCPA voluntarily. These accommodations to our donors, site users in California and are not intended to apply to individuals who are not California residents.

 

Required disclosures under state privacy laws, as well as additional information for California residents in terms of the categories and sources of information we collect, how we use that information, and how we may share that information. Other provisions of our privacy policy address these matters, we incorporate them again here for compliance with the California Consumer Privacy

We give options for your benefit, and We never discriminate against you for utilizing them. Yet, if you decide to delete your data, we will not be able to offer you any information, support, or other services that otherwise require Us to utilize your personal data.

 

"Deleting" Personal data is characterized by:

  • Permanently and completely deleting the data on existing hardrives/servers except for backup systems

  • Aggregating personal data. 

  • Conceal/redact personal information

Personal Information Storage - If personal information is archived or listed in a backup system, we have the right to delay compliance with the user’s request to delete, regarding data stored on the archived or backup system, until the archived or backup system is next accessed or used. Communication with the individual(s) of this when it is pertinent to their request.

 

Record-Keeping – According to the Civil Code section 1798. 105(d) We must maintain records of the individual request for deletion of personal data.

 

USA Kid Net is not required to comply with a consumer’s request to delete the consumer’s personal information if it is necessary for us or the service provider to maintain the consumer’s personal information in order to:

  • Comply with the California Electronic Communications Privacy Act as per Chapter 3.6 (beginning with Section 1546) of Title 12 of Part 2 of the Penal Code. 

  • Complete transaction(s) for which personal data was collected in order to provide service, donation, or to purchase good(s) at the request of user, or reasonably expected ongoing business or sponsor relationship with the user, or in any case execute an agreement between the organization and the user.

  • Detect security breaches, ensure against malicious, fraudulent, or criminal behavior; or indict those responsible for that type of activity.

  • Debug to recognize and fix errors that impede existing expected functionality.

  • Exercise free speech, guarantee the right of consumers to practice their right of free speech or exercise another right by applicable law.

  • Engage openly or in conjunction with a scientific, authentic, or factual study in the public interest that holds to any remaining relevant ethical and security laws, when the organizations' deletion of the data is likely inconceivable or impaired of such research, if informed consent was provided by the consumer.

    • To enable exclusively uses that are reasonably aligned with the user’s relationship with the business.

    • Otherwise utilize the donor’s data, internally, in a lawful manner in the context in which it was given.

    • Comply with Federal, State or municipal legal responsibilities.
